The Court upheld the Tribunal's conclusion that as at May 2000 the most probable (highest and best) use for much of the land was future residential development given the motorway designation, inclusion within the metropolitan urban limit and the draft structure plan; comparable sales evidence was the most reliable basis for valuation in the circumstances and justified the Tribunal's valuation of $3,780,000 (excluding GST) as at May 2000.
