Summary judgment was dismissed because there was an arguable defence that a novation occurred in December 2009 transferring the debt to Kingloch (with Mr King as guarantor) and releasing Mrs King; the plaintiff failed to establish beyond real doubt that no tenable defence existed and the authority of PGG officers and the factual matrix could not be finally determined on summary judgment.
