The High Court refused leave to appeal the guardianship direction because relocating the children to Tauranga would reduce the father's contact and require burdensome travel, contrary to the children's best interests; the week-on/week-off arrangement was endorsed as desirable but the practicality had not been sufficiently investigated, so the s48 appeal was allowed and the matter remitted to the Family Court to determine how a week-on/week-off regime can be implemented in a predictable and workable way.
