The High Court found on the facts a causal link between the appellant's methamphetamine addiction and personal deprivation and his dishonesty offending such that a 25% discount for personal circumstances would have been appropriate, but after correcting the guilty plea discount (reducing it from 25% to 20%) and applying the proper method (applying the guilty plea discount to the adjusted starting point per Moses), the imposed sentence of 30 months was not manifestly excessive and fell within the available range; the appeal was dismissed.

The Court held that Moses is a guideline judgment with limited retrospective effect and will not automatically overturn sentences imposed before 15 July 2020 unless special circumstances are shown; on the facts an extension of time to bring the appeal was granted because the imposed minimum period of imprisonment (nine years) was not justified given the length of the determinate sentence and the offender's youth and prospects, so the MPI was quashed while the determinate sentence of 15 years and five months was otherwise upheld.

FRASER v R [2020] NZHC 3504

The cultural report prepared under s27 was admissible and demonstrated a direct and credible linkage between Fraser's adverse cultural and personal history (childhood sexual abuse, substance abuse, loss and gang membership) and the offending, reducing moral culpability; this justified an additional five-month discount. The guilty plea discount must be recalculated from the starting point in line with Moses. Recalculation produced a final sentence of 32 months' imprisonment, so the appeal is allowed and the District Court sentence quashed and replaced accordingly.

The appeal is allowed and the global sentence reduced because the District Court erred by failing to give sufficient credit for personal and systemic mitigating factors (including cultural deprivation) when calculating discounts; the starting point for the methamphetamine offending was within range and not disturbed; guilty plea methodology per Moses should guide re-sentencing but failure to apply Moses alone is not necessarily error; cumulative sentencing was justified and did not require an additional totality reduction on these facts.

The Court revised sentencing methodology: replace the Hessell three-step approach with a two-step approach where (1) an adjusted starting point is fixed incorporating offense-based aggravating and mitigating factors and (2) all personal mitigation and the guilty plea discount are applied as percentages of that adjusted starting point (guilty plea discount capped at 25%). Applying the revised method and admitting the s 27 cultural report on appeal, the Court allowed the appeal, quashed the sentence below and substituted a term of seven years five months imprisonment.
