Interim relief was refused because the applicant failed to demonstrate necessity to preserve a real and protectable position without causing disproportionate prejudice to innocent parties; the variation of condition 19 to 19A was a lawful, workable response to commercial realities, was not so uncertain as to be void or to unlawfully delegate decision-making, and did not require public notification; the balance of convenience and public/private repercussions favoured refusal of an injunction.
