The Court held there was a seriously arguable dispute as to priority and that the balance of convenience and interests of justice required a holding order: the defendant, any receiver it appoints and its agents are restrained from marketing, selling, mortgaging or otherwise disposing of Creative Designer and Software Pty Ltd's assets pending further order, with timetabling for a full hearing on 7 December 2009; filing a protest to jurisdiction did not constitute submission to jurisdiction pursuant to Dale v Jeffrey.
