The Court found on the balance of probabilities that the appellant remained an employee who took paid annual leave and then unpaid leave with an intention and arrangement to return; clause 43 Schedule 1 therefore deems him to have continued in employment (within 28 days and the three month return period) so he was an "earner" immediately before his incapacity on 10 February 2009 and is entitled to weekly compensation.
