ZURU's explicit references in opening submissions and in Mr Mowbray's affidavit to specific privileged legal advice put that advice in issue under s65(3)(a) Evidence Act 2006; having regard to fairness and appellate authorities on imputed waiver, the privilege was effectively waived in respect of those documents and disclosure to opposing counsel on a counsel-only basis was required.
