The Court admitted the fresh medical evidence, applied Zhang v R to reassess the appropriate discounts, found exceptional circumstances (aggressive cancer, extensive community rehabilitation on bail, minimal operative role) justified an additional 17.5% discount so cumulative discounts reduced the effective sentence into the home detention range, quashed the 3 years 4 months imprisonment and substituted 12 months home detention conditional on an approved address and a s26A pre‑sentence report.
