The Court held the appellant had attempted to mislead the Probation Officer and the Court by omission, the pre-sentence report (apart from a minor error) accurately reflected the appellant's lack of remorse and circumstances, and therefore the Judge correctly declined home detention; a two year starting point reduced by 15% for plea to 20 months (rounded to one year eight months) and a $5,000 reparation order were not manifestly excessive.
