Deportation was not an inevitable consequence of conviction because statutory processes, ministerial powers to cancel or suspend deportation, and appeal rights permit consideration of the applicant's personal and family circumstances; therefore the risk of deportation was not a consequence out of all proportion to the gravity of the offending and discharge under s106 was not warranted, and no point of law of sufficient generality or risk of miscarriage justified leave to appeal to the Supreme Court.
