Because the Family Court orders made by Judge Druce remained on foot and were not to be reheard, the respondent remained the successful party despite the appellant's discontinuance; accordingly the respondent was entitled to costs on a Category 2B basis for all steps in the appeal with disbursements as fixed by the Registrar.
