The application for interim relief was dismissed because the plaintiff failed to demonstrate a serious question to be tried: the agreement was not conditional on obtaining resource consent, the plaintiff unreasonably delayed lodging the consent application (one day before settlement) and its inability to settle was self‑inflicted and not excused by COVID‑19, so interim suspension of the settlement notice was not justified.
