The court accepted contemporaneous treating medical evidence that the appellant was incapacitated from the end of the 2001 killing season (15 June 2001); therefore incapacity commenced then and the appellant was entitled to weekly compensation from the date after his last day of work until the date of operation and for the convalescence period thereafter.
