The appellant failed to prove on the balance of probabilities that he was incapacitated under s.105 between 23 June 2004 and 11 November 2008; the employment history and medical/occupational assessments indicate capacity for identified light work and rebut a finding of continuous incapacity from age 18; therefore ACC's decision denying weekly compensation as a potential earner is upheld and claims as to increased weekly compensation and quantum are outside the primary decision and must be addressed by ACC.
