Special leave to appeal is granted because it is arguable the District Court failed to take into account relevant considerations in a retrospective s105(2) incapacity assessment — specifically the absence of vocational rehabilitation and whether ACC should have proceeded under s107 — and because the weight and adequacy of the medical evidence relied on by ACC was sufficiently contestable to warrant appellate consideration.
