The amendment to s41(2)(b) only applies where the most recent income year ending before the commencement of incapacity was the first year in which the person received earnings other than as an employee; because the appellant had received such earnings in an earlier year, the amended provision does not apply and the respondent's prior calculation stands, so the appeal is dismissed.
