    F (SC 129/2016) v R [2017] NZSC 34

    Citation
    [2017] NZSC 34
    Court
    Supreme Court

Extension of time dismissed because applicant gave no adequate explanation for the delay and no compelling reason to grant an extension; the Court of Appeal was not shown to be in error as the jury could reasonably convict on the evidence given (including conduct consistent with conscious sexual activity and communication), the trial directions were not legally inadequate and were, if anything, favourable to the defendant, and the foreperson's limited acquaintance with the applicant's mother did not create a reasonable apprehension of bias or risk of miscarriage of justice.
