Because the plaintiffs discontinued the proceeding the defendant was entitled to costs under r15.23; the extent of discovery reviewed and the plaintiffs' failure to prosecute justified scale costs including band C for the defendant's list of documents; and Mr Pan was ordered jointly liable because he substantially controlled and would have benefited from the proceedings as sole director/shareholder and guarantor. The defendant's counterclaim for indemnity costs was not to be pursued further.
