The Court refused to make the intrusive, forensic and wide-ranging discovery orders because there was no proper jurisdictional basis to bypass the High Court Rules (particularly r8.19 and its enforcement mechanisms), the application was made belatedly and was overbroad, and the plaintiffs failed to justify exceptional relief given many documents were already disclosed or irrelevant; alleged deletions did not warrant the extraordinary orders sought and contempt jurisdiction was inappropriate for the relief requested.
