On the evidence as a whole, and applying the ordinary civil standard of proof, the Court was satisfied that the second draft will prepared by the solicitor, although unsigned and not seen by the deceased, expressed Mr Campbell's testamentary intentions because his instructions were accurately conveyed via his accountant and were corroborated by other evidence; accordingly the document was declared valid under s 14 Wills Act 2007.
