The application under s14 was dismissed because exhibit C did not appear to dispose of the deceased's property and did not express her testamentary intentions: the document contained inconsistent alternative dispositions, read as preliminary notes, and the prolonged delay without finalising a will undermined any inference of settled testamentary intention.

The November 2016 handwritten note was a document that appeared to be a will and, on the balance of probabilities, expressed Pamela's testamentary intentions; the heading, signature, dispositional content and corroborating contemporaneous notes and statements established sufficient evidence under s14 to declare it the valid last will.

The document dated 20 January 2008 satisfied the statutory definition of a will (s8) and expressed clear testamentary intentions; although it did not comply with the witnessing formalities of s11, s14(2) empowered the Court to validate it, and given consent from the affected next of kin the order could properly be made without notice, so the first page was declared the deceased's last will.
