The Court granted the extension of time because the delay was very minor and resulted from an inadvertent oversight by counsel, DS had prosecuted the appeal with reasonable diligence, there was no clear evidence the proposed appeal was hopeless, and the interests of justice favoured allowing the appeal to proceed; costs were reserved and suppression orders continued.
