The Court granted the extension of time because the delay was very minor and resulted from an inadvertent oversight by counsel, DS had prosecuted the appeal with reasonable diligence, there was no clear evidence the proposed appeal was hopeless, and the interests of justice favoured allowing the appeal to proceed; costs were reserved and suppression orders continued.

The court held s 64 did not render the defendants' documents undiscoverable because (1) s 51(5) excludes application of s 64 to communications made by an authorised representative, so documents emanating from the law firm were not protected by s 64; and (2) 'enforcement agency' in s 64 is confined to agencies enforcing New Zealand enactments (the definition of 'enactment' and reference to New Zealand Police indicate a domestic focus), so foreign bodies CAD and MAS are not enforcement agencies under s 64. The High Court held the unexpurgated search warrant application contained communications from a true police informer and was therefore subject to public interest immunity/informer privilege; the court has no general discretion to override that privilege in civil proceedings absent the narrow criminal exception, so the District Court's order for disclosure was set aside.
