The without-notice interim injunction limited to preventing exhibition or sales at the Auckland Boat Show and up to the 28 October on-notice hearing was refused. The Court found there was a serious question to be tried in respect of some drawings (notably A3, A8 and B1) but concluded the balance of convenience favored defendants for the limited period because damages would likely adequately compensate Sealegs for the short delay while the defendants would suffer irreparable marketing harm from being prevented to launch at the annual Boat Show; accordingly the interim injunction was dismissed…
