The court found the revocation of the power of attorney was valid, the funds in the defendant's Westpac account were the proceeds of the sale of the plaintiff's home and were held by the defendant on trust for the plaintiff, the defendant's entitlement to hold the funds had ended, and accordingly ordered the bank to provide statements, to pay the funds to the plaintiff, restrained the defendant from accessing the funds and ordered the defendant to pay the plaintiff's costs.
