COMMISSIONER OF POLICE v ANTOLIK [2017] NZHC 2436

    Citation
    [2017] NZHC 2436
    Court
    High Court

The Court approved the consent settlement because it was consistent with the Act's purposes and the overall interests of justice: it secured a substantial recovery for the Crown, achieved significant savings in time and cost, acknowledged litigation risk and the position of innocent third parties, and provided finality; accordingly the Court ordered release of $100,000 to Mr and Mrs Bozhenko and made a consent assets forfeiture order under s50 vesting the remaining restrained funds in the Crown, with the Commissioner undertaking not to pursue profit forfeiture and costs to lie where they fall.
