The Court allowed Mr Smith to pursue an out-of-time interlocutory challenge to the inspection order but ordered it be heard together with the substantive hearing on 10 March 2016; declined an adjournment; set aside Mr Smith's subpoenas as improperly served and an abuse of process; and imposed specific timetabling orders to permit testing of the legality and admissibility of inspection-derived evidence while preserving the scheduled hearing.
