    SMITH v JONES [2023] NZHC 3277

    Citation
    [2023] NZHC 3277
    Court
    High Court

The High Court has jurisdiction to hear appeals from Family Court interlocutory decisions under s39 read with the general appeal regime, but on the merits the without notice interim applications for occupation and insurance were dismissed because the appellant did not establish the exceptional urgency or risk of irreparable harm necessary for ex parte relief and the proposed additional evidence was not cogent or material to justify admission on appeal; the Family Court should deal with the matters on notice alongside the substantive proceedings.
