The Reviewer's decision was wrong: a claimant cannot establish entitlement to weekly compensation under Clause 32 via Clause 47(5) without satisfying section 103(2); sections 100 and 103 are cumulative and require the claimant to have been an earner at the time of the personal injury. Therefore the Reviewer's decision is quashed and the appellant's primary decision reinstated.
