Ngāti Tu ki Ngāpuhi was granted leave to appear as an interested party because it has a direct and legitimate interest as an applicant with overlapping or adjacent claims, its participation would assist the court, there is no prejudice to other parties and no opposition, and those factors justify allowing a late notice despite the statutory deadline.

CRHL was granted leave to appear as an interested party because it became the legal owner of the relevant infrastructure and the holder of the resource consents after the due date, thereby having a vital interest in the recognition proceedings; no opposition was filed, and granting leave was appropriate to protect that interest.

The Chairperson lawfully appointed the current panel under clause 5(1); the replacement provisions 5AA-5AC did not apply to the collective recusals which were institutional rather than personal circumstances; the reconstituted Tribunal may properly treat the rehearing as a new inquiry and must consider competing and overlapping claims before deciding on binding recommendations; accordingly the applicants' judicial review is dismissed.
