The without‑notice application for an interim stay could not properly be dealt with without notice because of the public safety issues raised by the Board's decision and the District Court's prior conclusion that the conditions were reasonable; accordingly the application was directed to be served on the respondent and the matter timetabled urgently rather than granted ex parte.
