The Court declined to award interim costs in respect of the earlier re‑pleadings and interlocutory steps because the rules relied on did not compel an early award and it would be premature to fix costs that could pre‑empt consideration of the substantive merits; the Court also refused to order security for costs because the applicant owned an unencumbered house of sufficient value to meet any costs award and the threshold for r 5.45 was not met.
