The Court exercised its inherent jurisdiction to grant interim, without‑notice orders permitting Santeater Ltd to act alone to sell or refinance Trust property and to receive and apply proceeds to retire debt, pay tax liabilities and outgoings, and fund due diligence for appointment of a new trustee, because the Trust's affairs were in a perilous state, mortgagee sales were imminent, immediate action was necessary to protect beneficiaries, and no defence had been filed to contest the relief.
