Although the applicant had a position to preserve and the threshold for s15 JRPA was arguably met, on discretionary balancing the Court found the merits of the intended claim neutral and the alleged prejudice speculative or remediable through ongoing consultation; the public and policy repercussions of restraining the Crown outweighed the need for interim relief, and therefore no interim orders were granted.
