The Court held that provisional relief under Schedule 1 art 19 of the Insolvency (Cross-border) Act 2006 can, in an appropriate case, include the issue of a search warrant to locate and seize assets concealed in New Zealand that are in jeopardy; the 'reason to believe' threshold was met on the evidence (corroborated informer intelligence and inquiries), so a tightly‑drafted warrant was justified, together with suspension of the bankrupt's rights in respect of NZ assets and an examination order, subject to protections for third parties and timetabled substantive hearing.
