The earlier interlocutory judgment by Joseph Williams J, having considered extensive affidavit material and submissions, definitively concluded it was not reasonably arguable that the liquidator was not entitled to treat the Interim Agreement as at an end; that determination is sufficiently final to found an estoppel per rem judicatam and therefore the plaintiff's second cause of action is precluded and must be struck out as disclosing no reasonably arguable cause of action.
