The Judge correctly concluded, on the appellant's own statements, that assets (gold and silver) convertible to money were available to him despite assertions they were held in trust; therefore he had not demonstrated inability to pay the filing fee and the application for leave, being personal and not of public importance, was properly declined.

The Court found that Mr Walker's change of representation and consequent inability to comply with the directed timetable caused true wasted costs to Ms Buxton; intention to cause waste was irrelevant to liability; it was just that Mr Walker pay Ms Buxton's wasted costs for 12–13 November 2019 fixed at $1,195.00.

Because the defendants brought a meritless application to review an orthodox interlocutory decision hopelessly and inexplicably out of time, causing unnecessary expense and prejudice, the court ordered increased costs under r 14.6 and awarded a 50% uplift totalling $8,529.75 plus disbursements of $265.87.
