Order B(2) was a tentative, prima facie conclusion rather than a final, appealable determination; order B(1) was an intermediary observation about adequacy of responses to a Court minute and is not appealable. Accordingly the High Court dismissed the appeal on the basis that there was no final decision in the relevant respects to found an appeal under s 299 RMA.
