A short suspension of an operator's licence under s58 imposed solely to penalise a past, non‑continuing breach (to deter or recover an overspend) is not within the scope of the suspension power in the Gambling Act 2003; in this case the suspension was imposed for a punitive purpose and is therefore invalid; exceeding limit D does not itself constitute a breach of s52(1)(d) or s106.
