The appellant was not an earner at the time his incapacity commenced because his accrued leave extended earner status only to 30 October 2008 but the earliest medical certification of incapacity was 3 November 2008; there is no evidence the ulcer existed or caused incapacity on or before 30 October, so the statutory requirements for weekly compensation under Clauses 32 and 43 were not satisfied.
