The Court granted media access to the pleadings, holding that the public interest in disclosure outweighed countervailing factors at this stage, and concluded that the term 'Judge' in the Access Rules should be interpreted to include Associate Judges of the High Court while recognising the point merits definitive appellate determination.

Where a matter is decided on the papers with no hearing, the formal court record under r 8(5) is limited to the judgment published by the Court; therefore documents beyond the judgment are not available as of right and the Registrar's refusal to provide those documents for Slavich and Guy was correct (in Guy r 8(5) did not apply because Guy was neither an appeal nor an application for leave).

Rule 10 is the prescribed general filing procedure in the Rules; therefore rule 5(4) is not engaged and interlocutory applications noted (including r 43(2) extension applications) may be filed electronically except where r10(7) expressly excludes a category (eg leave to appeal).

The amendment to the Court of Appeal rule did not change the established requirements for admitting further evidence on appeal; the Supreme Court will not entertain a Rule 40 application that collateralises a lower court's discretionary refusal to admit evidence — the correct course is to seek and obtain leave to appeal that evidentiary order before attempting to adduce the material in this Court.
