Earnings must be determined by reference to assessable income as returned for income tax purposes after allowable deductions; where a claimant with partial incapacity actually derives post-accident assessable income in excess of pre-accident earnings the respondent was entitled to suspend weekly compensation; a notional hourly-rate post-accident calculation is not the proper approach under s.41 and the Regulations.
