The court held that for s41(2)(b) the phrase 'the commencement of the period of incapacity' refers to the period after paragraph (a) within subsection (2)(b), so the most recent income year to be used is the year ending immediately before that later period (here the year ending 31 March 1995); accordingly the appellant's weekly earnings must be recalculated on that basis.
