The District Court made a factual finding, based on medical evidence, that the second incapacity commenced on 10 August 1995; therefore the appellant was not in permanent employment immediately prior to that date and weekly compensation was correctly calculated under section 40(2)(c). Because the appellant's complaint was about a factual finding and not an error of law, the application for leave to appeal under section 97 was rightly declined.
