Application dismissed because the October Deed was not fresh (known to applicant at the time of the November Deed), the applicant offered an inadequate explanation for a delay of over a year, the proposed appeal lacked merit insofar as it depended on the October Deed, and allowing the expanded appeal would prejudice other parties; consequently extension of time, leave to adduce the October Deed and waiver of privilege were refused and costs were awarded against the applicant.
