The Court awarded the respondent its claimed costs and disbursements because the Board succeeded on the contested statement issue, the withdrawal and reinvestigation did not amount to a concession of the applicant's claims and many claims were never argued so there was no basis to award costs to the applicant; without prejudice save as to costs offers reinforced that the matters could have been resolved and the respondent's claimed actual costs were reasonable and below a 2B benchmark.
