Although the trial judge's omission to refer to the need to affect a prosecution was a misdirection, on the facts the jury's finding that the accused intended to hinder or obstruct a police investigation made it an irresistible inference that he intended to affect any prosecution arising from that investigation; there was no miscarriage of justice and leave to appeal is refused.
