The High Court held the evidence sufficed to prove a s21(1)(e) offence because the encounter had the element of confrontation and the appellant had subjective knowledge his conduct was likely to intimidate the complainant; the trial judge properly preferred the complainant's credible evidence and made permissible inferences; no miscarriage of justice or apparent bias was established; and the $350 fine was within the available sentencing range and not manifestly excessive.
