    Because the appellant was legally aided and the Court was not satisfied exceptional circumstances existed (the procedural default was not exceptional and the appeal raised arguable issues), no costs order should be made against the appellant; payment of the judgment sum is to be arranged so that an amount estimated for Family Court costs is retained in respondent's solicitor trust account, with the balance payable forthwith and interest at 8.25% p.a. from seven days after this judgment on unpaid amounts, subject to discharge of notices of claim.
