The costs order was quashed because the Family Court judge made the order on the erroneous factual basis that the appellant was not legally aided and therefore failed to consider and apply s45 of the Legal Services Act 2011; the matter is remitted to the judge to reconsider the costs application applying s45.

Because both parties consented and agreed that Judge Walker had erred, the High Court allowed the appeal and directed that the proceeding be reheard by a differently constituted District Court.

No costs awarded against the second respondent because the judicial error was not of the second respondent's making, the second respondent did not defend the decision and promptly acted by consent to correct the error, and awarding costs would improperly make the respondent a surrogate for the court contrary to the Newton principle; exercise of discretion under r 14.7(g) requires that costs lie where they fall.
